The Genealogy: From Bastiat to Zombie Policies

The idea that actions produce consequences beyond what their authors intend is not modern. It is arguably the oldest insight in political thought. But the rigorous analysis of why this happens — not just that it does, but the structural mechanisms that guarantee it — has a specific intellectual genealogy that runs from nineteenth-century French economics through mid-twentieth-century sociology to contemporary complexity science.

Frederic Bastiat got there first, or at least got there most memorably. His 1850 essay “Ce qu’on voit et ce qu’on ne voit pas” (“That Which Is Seen and That Which Is Unseen”) established the foundational distinction. Every economic action has visible, immediate consequences and invisible, delayed consequences. The bad economist considers only the first. The good economist traces both. The broken window creates visible work for the glazier. It destroys invisible work that the shopkeeper’s money would have funded elsewhere. Bastiat did not formalize this — he was a pamphleteer, not a theorist — but the core insight was precise: human attention is structurally biased toward the immediate and visible, which means that the secondary consequences of any intervention operate in a cognitive blind spot.

Robert K. Merton provided the formal framework eighty-six years later. His 1936 paper “The Unanticipated Consequences of Purposive Social Action,” published in the American Sociological Review, was the first systematic attempt to catalog why deliberate interventions produce unintended results. Merton identified five sources of unanticipated consequences:

  1. Ignorance. The actor simply cannot acquire enough knowledge to anticipate all consequences. This is not a personal failing — it is an informational constraint inherent to complex systems.
  2. Error. The actor’s analysis of the situation is wrong. Habits that worked in the past are applied to situations where they do not fit. Familiar procedures are treated as universally applicable.
  3. Imperious immediacy of interest. The actor is aware of potential secondary consequences but is overwhelmed by the desire for the immediate result. Short-term interests override long-term caution. This is not irrationality — it is a different utility function, one that discounts the future at a rate the actor may later regret.
  4. Basic values. The actor is committed to values that prohibit consideration of certain consequences. A pacifist may refuse to consider the deterrent effects of military preparedness. An ideologue may refuse to consider the economic effects of policy they find morally necessary.
  5. Self-defeating prophecy. The prediction of a consequence leads to actions that prevent it — the opposite of Merton’s more famous “self-fulfilling prophecy.” Fear of a bank run leads to deposit insurance, which prevents the bank run. The unintended consequence is itself prevented by the anticipation of it.

Merton’s taxonomy was elegant, but it was also incomplete. It treated unanticipated consequences as failures of foresight. What it did not adequately address was the possibility that consequences might be fully anticipated but politically tolerated — a gap that would not be properly filled for another ninety years.

Charles Goodhart, an economist at the Bank of England, articulated the measurement problem in 1975. His original formulation, embedded in a paper on monetary policy in the United Kingdom, was narrow: “Any observed statistical regularity will tend to collapse once pressure is placed upon it for control purposes.” Goodhart was talking about the relationship between money supply measures and inflation — the Bank of England had been targeting specific monetary aggregates, only to find that as soon as a particular measure became a policy target, banks and financial actors adjusted their behavior to circumvent it, destroying the informational value of the measure itself.

The generalized version — “When a measure becomes a target, it ceases to be a good measure” — was not Goodhart’s own phrasing, but it captured the dynamic precisely. The act of targeting a metric changes the behavior of the agents being measured, which changes the meaning of the metric, which invalidates the reason it was chosen as a target. This is not a problem that can be solved by choosing better metrics. It is a structural feature of any system where measured agents have the capacity to adapt.

Donald Campbell, a psychologist and methodologist, arrived at the same conclusion independently in 1976: “The more any quantitative social indicator is used for social decision-making, the more subject it will be to corruption pressures and the more apt it will be to distort and corrupt the social processes it is intended to monitor.” Campbell’s Law is Goodhart’s Law with the mechanism made explicit: it is not merely that the metric degrades — it is that people actively corrupt it because their incentives now point at the number rather than the underlying reality.

G.K. Chesterton contributed what amounts to a conservative heuristic. Chesterton’s Fence, from his 1929 book The Thing, proposes that before removing any institution or practice whose purpose is not immediately apparent, you must first understand why it was erected. “If you don’t see the use of it, I certainly won’t let you clear it away.” The fence may look pointless. It may in fact be pointless. But the burden of proof falls on the reformer. This is a precautionary principle specifically directed at the problem of second-order effects: the fence may be preventing consequences that are invisible precisely because the fence is working.

Nassim Nicholas Taleb extended the framework in two directions. First, iatrogenics — harm caused by the healer. The concept comes from medicine (iatrogenic illness is illness caused by medical treatment), but Taleb generalized it to any intervention: the cure can be worse than the disease, particularly when the system being intervened upon is complex and the intervener does not fully understand its dynamics. His second contribution was antifragility — the property of systems that benefit from disorder. Fragile systems break under stress. Resilient systems survive it. Antifragile systems get stronger. The implication for second-order effects is that attempting to eliminate all volatility from a system (as regulation often does) may make the system more fragile, not less — the suppressed volatility accumulates and is released catastrophically. The Great Moderation preceding the 2008 financial crisis is the canonical example.

The Streisand Effect, coined by Mike Masnard in 2005, added the information-age dimension: attempts to suppress information often amplify its spread. Barbra Streisand’s 2003 lawsuit to suppress aerial photographs of her Malibu home drew 420,000 views to an image that had previously been downloaded six times. The mechanism is straightforward — the act of suppression generates attention, which generates curiosity, which generates distribution — but the pattern recurs because institutions systematically underestimate the degree to which their own reactions become the story.

Most recently, a 2025 paper by B. Guy Peters and Maximilian L. Nagel in Policy and Society introduced the concept of zombie policies — well-intentioned policies whose unintended consequences have made them net-negative, but which persist because the malign aspects benefit powerful political and economic interests. The policy continues to shamble forward, producing harm, because no constituency with sufficient power benefits from killing it. This is Merton’s “imperious immediacy of interest” scaled up to institutional level and extended across decades.


The Core Mechanisms

The genealogy maps the intellectual history. The mechanisms explain why second-order effects are not occasional accidents but structural features of intervention in complex systems.

Mechanism 1: Metric Corruption (Goodhart/Campbell)

When you measure a system and act on the measurement, you change the system’s behavior. This is not a bug — it is the point. The problem arises when agents within the system optimize for the metric rather than the underlying reality the metric was intended to capture. The metric and the reality decouple. The dashboard turns green while the building burns.

The mechanism operates through a predictable sequence:

  1. A metric is identified that correlates with a desired outcome.
  2. The metric is made into an explicit target with rewards attached.
  3. Agents discover that optimizing the metric directly is easier than improving the underlying reality.
  4. The metric improves. The underlying reality stagnates or deteriorates.
  5. Decision-makers, looking at the metric, conclude that their intervention is working.
  6. The gap between metric and reality widens until a crisis exposes it.

This sequence has played out in Soviet central planning, American education, corporate banking, web performance, and essentially every domain where quantitative targets are attached to rewards for human agents who retain the ability to game the system.

Mechanism 2: Perverse Incentives (The Cobra Effect)

A policy creates an incentive structure that rewards the opposite of the intended behavior. The classic example — the British colonial government in India offering bounties for dead cobras, allegedly leading to cobra farming — may be apocryphal. A 2025 investigation by the Friends of Snakes Society found no contemporary documentation of cobra breeding operations in the colonial record. The Madras bounty program was scaled back in 1873 due to costs, not fraud.

But the pattern the story illustrates is real and extensively documented in verified cases. The structure is simple: the policy rewards an observable proxy for the desired outcome, and agents discover they can produce the proxy without producing the outcome — or worse, by actively undermining it.

Mechanism 3: Adaptive Circumvention

Complex systems contain intelligent agents who respond to constraints by finding paths around them. Financial regulation is the paradigmatic case. Dodd-Frank’s Volcker Rule restricted proprietary trading by banks. Banks moved critical functions to shadow banking entities. The Wharton School’s five-year assessment found that the regulations had pushed risky banking activities to less-regulated institutions, potentially making the financial system more fragile rather than less. Capital requirements intended to reduce risk increased the incentive for regulatory arbitrage, driving demand for shadow-banking instruments that operated outside the regulatory perimeter.

This is not corruption. It is rational behavior by agents responding to a changed incentive landscape. The regulation changed the rules; the agents changed their strategies. The regulators, thinking in terms of direct effects, did not anticipate that the agents would treat the regulation as a constraint to be optimized around rather than a command to be obeyed.

Mechanism 4: Demand Induction

Adding capacity to a congested system can increase total demand rather than reducing congestion. The Katy Freeway in Houston — expanded to 23 lanes at a cost of $3 billion — saw commute times increase within three years of the expansion. The mechanism is not paradoxical once you model the system correctly: expanded road capacity makes driving relatively more attractive, which induces new trips and route changes, which fills the new capacity. The system reaches a new equilibrium at roughly the same level of congestion but with more total traffic.

Braess’s paradox is the mathematical formalization: in a network where agents selfishly choose optimal routes, adding a new link can reduce the performance of the overall system. The counterintuitive result — verified both theoretically and in real-world cases like the removal of San Francisco’s Embarcadero Freeway, after which traffic improved — demonstrates that second-order effects in networked systems cannot be predicted by reasoning about individual components in isolation.

Mechanism 5: Temporal Displacement

An intervention produces immediate benefits and delayed costs, or vice versa. Rent control is the textbook case. A 2019 Stanford study (Diamond, McQuade, and Qian, published in the American Economic Review) examined a 1994 rent control expansion in San Francisco and found that while rent control reduced displacement of incumbent tenants in the short run, landlords responded by converting 15% of rental housing to condos or owner-occupied units, removing it from the rental supply. The reduced supply drove a 5.1% city-wide rent increase, ultimately undermining the policy’s stated goal. The beneficiaries were visible and immediate (current tenants paying below-market rent). The costs were diffuse and delayed (future tenants facing higher market rents in a shrinking supply).


The Case Files

Soviet Production Quotas: The Parable of the Nails

Soviet central planning provides the purest laboratory for Goodhart’s Law because the system combined explicit quantitative targets with powerful incentives and no market mechanism to correct misallocation.

The nail factory parable — possibly apocryphal in its specifics but representative of documented dynamics — runs as follows: Moscow set production quotas by number of nails produced. Factories responded by manufacturing enormous quantities of tiny, unusable nails. Moscow revised the quota to weight. Factories produced a small number of enormous railroad-spike-type nails weighing a pound each. Neither set of nails addressed the actual nail shortage.

The pattern extended beyond nails. Chandelier manufacturers made ever-heavier chandeliers to hit weight quotas. University dormitories received tiny lamps with lead-filled bases. Data fiddling became endemic — factory managers reported fulfilled targets regardless of actual output, entrenching the crisis because the information flowing upward to planners was systematically corrupted by the incentive structure that the planners themselves had created. The system’s feedback loop was broken at the point of measurement.

Wells Fargo: 3.5 Million Fake Accounts

In September 2016, the Consumer Financial Protection Bureau fined Wells Fargo $100 million for the creation of approximately 1.5 million unauthorized deposit accounts and 623,000 unauthorized credit card accounts in customers’ names. The total eventually grew to an estimated 3.5 million unauthorized accounts across multiple product lines.

The mechanism was pure Campbell’s Law. Wells Fargo’s “Great Eight” initiative set a target of eight products per household — a number chosen by then-CEO John Stumpf because “eight rhymes with great.” Branch employees faced intense pressure to cross-sell, with their compensation, continued employment, and career advancement tied to the metric. Employees discovered that opening unauthorized accounts was easier than genuinely selling products customers wanted. Management, seeing the cross-sell numbers improve, concluded their strategy was working. The gap between metric and reality widened for over a decade before whistleblowers and regulators exposed it.

The consequences were severe: $3 billion in criminal and civil settlements with the DOJ in 2020, an additional $3.7 billion CFPB settlement in 2022, more than 5,300 employees fired, and a Federal Reserve-imposed asset cap that constrained the bank’s growth for years. The metric had become the target, and the target had consumed the institution.

Atlanta Public Schools: 178 Educators

The Atlanta Public Schools cheating scandal is the educational system’s Wells Fargo. Under Superintendent Beverly Hall, Atlanta tied teacher evaluations, compensation, and job security to standardized test score improvements. Hall herself received performance bonuses exceeding $500,000 based on the resulting gains.

The metric responded beautifully. Test scores rose dramatically across the district. The underlying reality was that 178 educators across 44 schools were systematically correcting students’ answer sheets. The state investigation, triggered by statistical anomalies in score patterns, found that teachers held “erasure parties” to alter completed tests. In 2013, 35 APS educators were indicted on racketeering charges. In 2015, eleven of twelve defendants were convicted under the Georgia RICO Act.

The students whose scores had been inflated were promoted to grade levels for which they were unprepared and denied the remedial support they actually needed. The intervention designed to help disadvantaged students — accountability through testing — actively harmed the students it was supposed to serve.

The War on Drugs: Predicted Consequences

The War on Drugs, declared by Richard Nixon in 1971 and dramatically escalated under Ronald Reagan in the 1980s, is the case that most directly challenges the “unintended” label.

The consequences: Between 1975 and 2019, the U.S. prison population surged from 240,593 to 1.43 million, with approximately one in five incarcerated for a drug offense. The racial disparity was staggering — the Black incarceration rate exploded from approximately 600 per 100,000 in 1970 to 1,808 per 100,000 in 2000, despite the fact that drug usage rates are roughly equal across racial groups. Black Americans became nearly six times more likely to be incarcerated for drug-related offenses than white Americans.

Were these consequences “unintended”? Critics at the time predicted exactly this outcome. Public health experts argued that criminalizing addiction would produce mass incarceration without reducing drug use. Civil rights advocates warned that selective enforcement would devastate Black communities. John Ehrlichman, Nixon’s domestic policy advisor, later admitted in a 1994 interview (published by Harper’s in 2016) that the drug war was designed to target political opponents: “We knew we couldn’t make it illegal to be either against the war or Black, but by getting the public to associate the hippies with marijuana and Blacks with heroin, and then criminalizing both heavily, we could disrupt those communities.”

A 2026 paper by Paul Kelaita in Social Policy proposed reframing such cases as “politically acceptable effects” rather than “unintended consequences” — arguing that when effects are predicted by critics and ignored because they serve political interests, the “unintended” label actively obscures the political calculations that produced the outcome.

Financial Regulation: Dodd-Frank and the Migration of Risk

The Dodd-Frank Wall Street Reform and Consumer Protection Act (2010) was designed to prevent a recurrence of the 2008 financial crisis. It succeeded in making traditional banks safer by conventional measures — higher capital requirements, stress testing, restricted proprietary trading. But the Wharton School’s five-year review found that these regulations had pushed critical banking functions into the shadow banking system, where they operated with less oversight and less transparency.

The Volcker Rule restricted banks from proprietary trading. Banks moved trading activities to less-regulated affiliates or spun them off entirely. Higher capital requirements made shadow-banking instruments more attractive by comparison. The regulatory perimeter was drawn around banks; financial risk migrated to entities outside the perimeter. Regulatory arbitrage — the rational response of intelligent agents to a changed constraint landscape — became the defining dynamic. The system was arguably safer within the regulatory perimeter and less visible outside it.

This is adaptive circumvention at scale, and it illustrates why second-order thinking requires modeling agents as strategic actors rather than passive objects. The regulation assumed banks would comply with the spirit of the law. Banks complied with the letter of the law and circumvented the spirit.

Web Performance: Lighthouse Scores vs. Real UX

The software engineering world has its own Goodhart’s Law laboratory. Google’s Lighthouse performance audit produces a score from 0-100 that measures page load speed, accessibility, and best practices. The score became a target — for SEO rankings, client deliverables, and developer performance reviews.

The result, documented in a 2024 analysis by web performance researchers, was that some “performance experts” began offering “100 score in Lighthouse” as a service — while actually delivering trimmed-down experiences that detected the Lighthouse audit bot and served it a stripped-down version of the page. The score was perfect. The actual user experience was degraded or unchanged. The metric had decoupled from reality in the same way that Soviet nail quotas had decoupled from actual nail supply.

Code coverage metrics tell the same story. When “80% code coverage” becomes a target, developers write tests that touch every line without actually testing meaningful behavior. The coverage number improves. The test suite’s ability to catch bugs does not. The metric becomes the target; the target becomes the game.


The Limits

Second-Order Effects is the most practically useful model on the list of ten. It is also the most dangerous to treat as complete.

Limit 1: The Inaction Excuse

The model’s greatest risk is that it becomes a general-purpose argument against doing anything. Every intervention has second-order effects. Therefore every intervention is risky. Therefore the safest course is inaction. This reasoning is logically valid and practically catastrophic. Climate change, pandemic response, financial crises — all are domains where the second-order effects of inaction dwarf the second-order effects of imperfect intervention. The model provides no framework for comparing the second-order effects of action versus the second-order effects of inaction. It simply says “be careful,” which is advice that never specified a direction.

In practice, the inaction bias serves whoever benefits from the current arrangement. “We should be cautious about unintended consequences” is a sentence that has been deployed against environmental regulation, financial regulation, civil rights legislation, public health mandates, and essentially every reform that threatens existing power structures. The model, intended as a tool for better thinking, becomes a rhetorical weapon for preserving the status quo.

Limit 2: No Predictive Specificity

The model tells you that second-order effects will occur. It cannot tell you which ones. It says “your intervention will produce consequences you did not intend.” It does not say “your intervention will produce these specific consequences.” This is the difference between a warning and a forecast. A warning that says “something bad might happen” is infinitely less useful than a forecast that says “this specific thing will happen with this probability.” Second-order effects analysis is permanently stuck at the warning level because the specifics depend on the details of the system, the intervention, the agents, and their interactions — all of which are the province of other models (game theory, cybernetics, complex adaptive systems) rather than this one.

Limit 3: Survivorship Bias in the Teaching

We teach second-order effects almost exclusively through examples of failure — the cobra effect, Soviet nails, Wells Fargo. This creates a systematically distorted picture. For every intervention that backfired spectacularly, there are interventions that produced positive second-order effects, or whose second-order effects were successfully anticipated and managed. Seat belt laws were predicted to increase reckless driving (the Peltzman effect). The actual evidence is that traffic fatalities declined dramatically. Smallpox vaccination had positive second-order effects (economic productivity gains, reduced healthcare costs) that vastly exceeded the primary effect. But these cases are boring. They do not make memorable parables. The teaching of the model selects for dramatic failures, which inflates the perceived frequency and severity of second-order effects relative to their actual base rate.

Limit 4: Chesterton’s Fence Can Calcify

The conservative heuristic — understand the purpose of an institution before dismantling it — is sound in principle. In practice, it degenerates into a demand that reformers prove a negative: prove that the institution serves no purpose before removing it. Since proving a negative is effectively impossible, the heuristic becomes a permanent defense of every existing institution, regardless of whether it currently serves any function. Chesterton’s Fence was designed to impose a burden of inquiry. It can become a burden of paralysis.

Limit 5: The Model Has No Positive Program

This is the deepest limit. Second-Order Effects is entirely negative. It says: “be careful.” It says: “things will go wrong in ways you did not expect.” It says: “your metrics will be gamed, your regulations circumvented, your incentives perverted.” What it does not say is: “here is what you should do instead.” It is the intellectual equivalent of a smoke alarm — essential, but incapable of building a building. A thinker armed only with this model becomes an extremely sophisticated critic who cannot propose, create, or construct anything. The world needs builders, not just people who explain why buildings will collapse.


The Connections

Cybernetics: Second-Order Effects as Ignored Feedback Loops

The cybernetic framework reveals what second-order effects actually are in systems terms: they are feedback loops that the designer of the intervention failed to model. Every case study in this report is a story of a missing feedback loop. Soviet planners set production targets (the input) but had no reliable mechanism for feeding back information about whether the output actually served the system’s needs. Wells Fargo set cross-sell targets but severed the feedback loop between customer experience and the metric. Atlanta set test score targets but eliminated the feedback between student learning and measured performance.

Donella Meadows’ hierarchy of leverage points maps directly onto this analysis. The lowest-leverage intervention is changing a number (a production quota, a test score target, a cross-sell metric). The highest-leverage intervention is changing the system’s goals, its rules, or its capacity to self-organize. Second-order effects are most severe at the low-leverage interventions — precisely because those are the interventions most commonly implemented, being the easiest to mandate and the most legible to bureaucracies.

Game Theory: Campbell’s Law as Mechanism Design Failure

Campbell’s Law — “the more a metric is used for decision-making, the more it will be corrupted” — is, in game-theoretic terms, a statement about the failure of mechanism design. When you attach incentives to a metric, you create a game. The agents being measured are players in this game. If the game is poorly designed — if it rewards the metric rather than the underlying outcome — the players will optimize for the metric. This is not corruption. It is the Nash equilibrium of a badly designed game.

Mechanism design — the branch of game theory concerned with designing rules that produce desired outcomes when agents behave strategically — is the formal response to Campbell’s Law. If you know agents will game the system, design the system so that gaming it produces the outcome you want. Auction theory (Vickrey, Myerson) does this successfully. Incentive-compatible mechanisms align individual optimization with system goals. The insight is that second-order effects are not inevitable — they are the consequence of naive mechanism design. Sophisticated mechanism design can anticipate and channel strategic behavior.

But mechanism design has its own second-order failure mode: the Myerson-Satterthwaite theorem proves that no mechanism can simultaneously be efficient, individually rational, and budget-balanced in bilateral trade with private information. The theoretical ceiling on mechanism design limits the practical ceiling on preventing second-order effects. Some games cannot be designed to produce optimal outcomes.

Complex Adaptive Systems: The Cobra Effect as Category Error

The cobra effect — whether historically real or not — describes what happens when you treat an adaptive system as a mechanical one. In a mechanical system, introducing a bounty on cobras removes cobras. In an adaptive system, introducing a bounty on cobras creates a new economic niche (cobra farming) that increases the cobra population. The intervention assumes the system is static. The system is dynamic. The agents within it respond to the intervention by changing their behavior, and the behavior change creates a new system state that was not part of the original model.

Complex adaptive systems theory provides the formal vocabulary for this: the system exhibits emergence, where macro-level patterns arise from micro-level interactions in ways that cannot be predicted from the components alone. Self-organization means agents coordinate without central direction. Co-evolution means the agents and the environment change each other. The cobra effect is co-evolution: the policy (environment) changed the agents’ behavior (cobra farming), which changed the environment (more cobras), which invalidated the policy. Treating an adaptive system as if it were a mechanical one — as if agents would simply comply rather than adapt — is the category error that generates second-order effects.

Evolutionary Dynamics: Selection Pressure Creates Resistance

The evolutionary lens explains why second-order effects are not just likely but inevitable in any system with variation and selection. Antibiotic use creates selection pressure favoring resistant bacteria. Pesticide use creates selection pressure favoring resistant pests. Regulation creates selection pressure favoring regulatory arbitrage. Drug enforcement creates selection pressure favoring more sophisticated trafficking networks. In every case, the intervention selects for entities that can survive or circumvent it, which means the population shifts over time toward the very characteristics the intervention was designed to eliminate.

This is not metaphorical. It is the same mechanism operating across different substrates. The formal structure — variation, selection, differential reproduction — does not require biological organisms. It requires only that agents vary in their strategies, that the environment (including policy) selects among those strategies, and that successful strategies proliferate. Financial firms that discover regulatory loopholes grow and are imitated. Trafficking networks that evade enforcement survive while those that do not are eliminated. The intervention, over time, breeds its own opposition.

Prospect Theory: Nudges That Backfire

Prospect Theory’s applied arm — behavioral nudging — is itself subject to second-order effects. The PNAS meta-analysis estimated that approximately 15% of nudge interventions backfire, producing the opposite of the intended effect. The Netherlands’ shift to organ donation opt-out produced a 40x spike in non-donor registrations — people who would never have bothered to register their preference were triggered by the policy change to actively opt out.

The deeper connection is through framing. Prospect Theory demonstrates that how a choice is presented determines the decision. Second-order effects analysis reveals that the framing itself produces unintended consequences. A policy framed as protecting workers (minimum wage increases) produces second-order effects on employment. A policy framed as increasing access to housing (rent control) produces second-order effects on housing supply. The frame captures attention on the intended first-order effect. The second-order effect operates in the cognitive blind spot that Bastiat identified in 1850 — the unseen consequence, invisible precisely because the frame was designed to make the seen consequence salient.

Information Theory: Goodhart’s Law as Signal Corruption
